Dani Alves will stand trial in Spain on a sexual assault charge.

The Barcelona-based court stated that “there was enough evidence to open the trial” based on the statements made to the court and the evidence presented during the investigation phase. The hearings had yet to be scheduled.

Alves, 40, has been in pre-trial detention since January, when he was arrested for allegedly assaulting the woman on December 30 at a nightclub in Barcelona. In August, he was indicted by an investigative judge.

The former Barcelona defender has denied any wrongdoing, claiming he and the accuser had consensual sex.

According to Spain’s sexual consent law, which was passed last year, the charge of sexual assault encompasses a wide range of crimes, from online abuse and groping to rape, each with a different potential punishment. Rape can result in a maximum sentence of 15 years in prison.

Alves won 42 soccer titles, including three Champions Leagues and two Copa Americas with Barcelona. He competed in his third World Cup in Qatar last year.

After reviewing the initial investigation by authorities and hearing testimony from the alleged victim, witnesses, and the player himself, a judge sentenced him to prison in January.

Alves’ bail requests were all denied because the court deemed him a flight risk. While waiting for the court’s decision, the player offered to surrender his passports and wear a tracking device.

On Tuesday, Alves’ lawyers did not immediately respond to a request for comment.
